The game \u201c142nd<\/sup> KlassenLotterieNord\u201c (hereinafter referred as \u201cKLN-game\u201c) is organized by EU Lotto Ltd. EU Lotto is a state-licensed bookmaker based in Gibraltar (EU), whose main business is accepting bets on the outcome of lotteries. EU Lotto holds a gambling license issued by the Gibraltar government (license no. RGL 066). EU Lotto does not provide lottery tickets for state lotteries, but organises betting on the outcome of lotteries. A bet on the outcome of the following lotteries is hereinafter referred as \u201cticket\u201d: (1) According to the law, the participation of minors in gambling is not permitted. For this reason, the person, who likes to play (hereinafter referred as \u201cinterested party\u201d), has to provide his name, date of birth and address truthfully.<\/p>\n\n\n\n (2) EU Lotto and its service providers are legally obliged to check the age of the interested party. Recognized procedures are used for this age of majority verification; the required data will be passed on to third parties. For this purpose the name, date of birth and address of the interested party are transmitted. A credit check and a further transfer of personal data will not take place. The request is stored for the purpose of billing with EU Lotto and where applicable in the population registers for the required period.<\/p>\n\n\n\n (3) If it cannot be confirmed by a procedure pursuant to section 2, the interested party will be informed immediately. The interested party may then provide the proof of age in another suitable manner.<\/p>\n\n\n\n (4) If a personal contact with employees of the service provider takes place in order to initiate and conclude the contract, they are in cases of doubt entitled and required to ask for an official identity document or a notarized copy of an official identity document to ensure the participation ban of minors.<\/p>\n\n\n\n (1) According to the profit plan, the 142nd <\/sup> KLN-game will be carried out over 6 months in 6 classes of one month each. <\/p>\n\n\n\n (2) 3,000,000 tickets will be issued. These tickets include 2,129,430 cash prizes (including 300 extra monthly income for one year and 30,000 cash prizes in the special draw), up to 6 additional jackpots, 10,000 Gold prizes and 1,001 non-cash prizes (335 cars, 350 holiday trips and 15 houses plus 300 cruise trips in the cruise-draw as well as an island in the New Year\u2019s draw). (3) For each class, whole tickets (1\/1), half tickets (1\/2), quarter tickets (1\/4), eighth tickets (1\/8) and sixteenth tickets (1\/16) are issued. Each ticket has a 7-digit number from 0,000,001 to 3,000,000 and a letter. The 1\/1 ticket has the letter A. The 1\/2 ticket the letter A or B. The 1\/4 ticket the letter A, B, C or D. The 1\/8 ticket the letter A, B, C, D, E, F, G or H and the 1\/16 ticket the letter A, B, C, D, E, F, G, H, I, J, K, L, M, N, O or P.<\/p>\n\n\n\n (4) The total prize value is \u20ac 1,430,700,000. This amount is split into \u20ac 1,364,860,000 cash prizes, \u20ac 30,000,000 Gold prizes and \u20ac35,840,000 non-cash prizes. The planned average payout rate over all 6 classes is 49.68%.<\/p>\n\n\n\n (1) The ticket price per class is \u20ac 160.00 for a whole ticket, \u20ac 80.00 for a half ticket, \u20ac 40.00 for a quarter ticket, \u20ac 20.00 for an eighth ticket and \u20ac 10.00 for a sixteenth ticket. <\/p>\n\n\n\n (2) If a player acquires in the course of the 142nd<\/sup> KLN-game a ticket not previously played by him or if the player resumes playing after interruption at a subsequent class, the price for the tickets for the previous unpaid classes has also to be paid.<\/p>\n\n\n\n (3) The costs for the winning lists including the postage are charged to the player.<\/p>\n\n\n\n (1) The tickets are distributed by service providers on behalf of and for the account of EU Lotto.<\/p>\n\n\n\n (2) In accordance with \u00a7 2 (1) the details of the player as well as his bank account and the ticket assigned to him with number and letter are registered by the service provider in a directory.<\/p>\n\n\n\n (3) The player must immediately notify the service provider in case of changes to his name, address or bank details. Damage caused through culpable violation of this obligation shall be borne by the player. \u00a7 12 (3) shall apply accordingly in the case of damages caused by the player.<\/p>\n\n\n\n (4)\nWith the ordered ticket the service provider is entitled to issue a ticket\ncertificate and send it to the player. The ticket certificate can be issued for\nseveral classes and for several ticket numbers. These playing conditions apply\nto the ticket certificates accordingly.<\/p>\n\n\n\n (5)\nTickets may be issued as \u201cvirtual tickets\u2019 and subject to the gambling licence.\nThe ticket numbers and letters are then only stored in the EU Lotto database, and\ncommunicated informally to the player.<\/p>\n\n\n\n (6)\nThe player does not have the right to participate to the game with a ticket\nnumber of their choice. However, EU Lotto will try to comply with requests for\na certain ticket number where possible.<\/p>\n\n\n\n (7)\nFor distance contracts there is no right of revocation.<\/p>\n\n\n\n (1)\nThe gaming contract is concluded between EU Lotto and the player according to\nthe following paragraphs with the payment of the lottery ticket price and\nstorage of the transaction. <\/p>\n\n\n\n (2)\nFor the participation in all drawings of a class with entitlement for winnings\na) the lottery ticket price must be paid on time (section 3) and in full amount\n(sections 5 and 6), depending on the requirement of the service provider to an EU\nLotto account or to an account of the service provider and (b) the transaction\nmust be stored in the EU Lotto database prior to the beginning of the first\ndraw of that class.<\/p>\n\n\n\n (3)\nThe ticket is paid on time if, at the latest, by the end of the penultimate\nworking day (without Saturdays) before the beginning of a game a) the ticket\nprice has been transferred to EU Lotto or the service provider in cash, by\npostal order or by bank transfer and EU Lotto or the service provider was able\nto gain knowledge of it, b) a check with the amount of the ticket price has\nbeen provided to the service provider and the check payment does not fail for\nreasons for which the player is responsible, c) EU Lotto or the service\nprovider is authorized to collect the ticket price from an account of the\nplayer via direct debit unless the collection of the ticket price does not fail\nand\/or is not delayed for reasons which the player is responsible for or the\ndebit is canceled because the player subsequently contradicts its collection.\nFor credit cards, this provision applies accordingly.<\/p>\n\n\n\n (4)\nAfter the time mentioned in section 3, the participation in the game begins on\nthe day of the next main draw or the next major draw or special draw or jackpot\ndraw of the 6th<\/sup> class, if the ticket price has been paid no later\nthan the penultimate working day (excluding Saturdays) before this draw.<\/p>\n\n\n\n (5)\nIn case of incomplete payment for the lottery ticket price, EU Lotto or the\nservice provider keeps the part of the paid amount, which is insufficient for\nthe payment of the lottery ticket. If the ticket price is fully paid at a later\ntime, section 4 applies accordingly. Otherwise the amount may be used for the\nnext lottery ticket order or will be paid back to the player upon request to EU\nLotto or the service provider.<\/p>\n\n\n\n (6)\nIf the ticket is paid using the SEPA direct debit procedure, the\npre-notification deadline is reduced to one working day (excluding Saturdays).\nThe pre-notification of the direct debit of the stake is done via letter or\nemail.<\/p>\n\n\n\n (7)\nIf the player wants to participate in the game with several ticket numbers and\nhe does not pay the total price for the tickets, the paid amount will be\nprocessed in the following order: a) on whole tickets, b) on half tickets, c) on\nquarter tickets, d) on eighth tickets, e) on sixteenth tickets, provided that\nthe paid amount is sufficient and the player has not made any other provision. If\nthere are several ticket numbers with the same split, the paid amount will be\nused for the tickets with the lowest ticket numbers. \u00a7 13 (4) and \u00a7 3 (2) in\npart 2 of these Terms and Conditions shall remain unaffected. For the rest,\nsection (5) applies.<\/p>\n\n\n\n (1)\nEach ticket is only valid for the class it belongs to. To continue the\nparticipation to the lottery game, the service provider who provided the ticket\nfor the preliminary class will offer the player a ticket with the same number\nand the same letter for the next class (renewal ticket). The player is not\nobliged to accept\/buy the renewal ticket.<\/p>\n\n\n\n (2)\nIf the player can\u2019t participate in the lottery game with a renewal ticket\ndespite the timely payment of the ticket price and therefore the continued\nusage of the previous ticket number is not possible, the player is entitled to\nplay for free with twice the amount of tickets he is entitled to, with other\nnumbers, for all subsequent classes. The liability regulations of \u00a7 12 (1)\napply.<\/p>\n\n\n\n (3)\nThe service provider will generally offer tickets for the 1st<\/sup> class\nof the next KLN-game to the player of the 6th<\/sup> class according to the\ntickets he plays, unless the player has stated otherwise.<\/p>\n\n\n\n (4)\nThe participation in the lottery game may be terminated by the player at the\nend of each class, even if the player has received a ticket certificate or a\nvirtual ticket (in accordance with \u00a75 (5) with a validity period covering\nseveral classes. The participation in the lottery can be terminated before each\nclass by EU Lotto, even if the ticket price has already been paid. In this case\nEU Lotto or the corresponding service provider will reimburse the ticket price.<\/p>\n\n\n\n (5)\nThe transfer of the claims out of the gambling contract requires the consent of\nthe service provider. The consent is granted and the new claimant will be\nregistered in accordance with \u00a7 5 (2) if he fulfills the participation\nrequirements.<\/p>\n\n\n\n (1)\nIn case of cash prizes, EU Lotto pays to the player the same amount that the\nplayer would have received if he would have taken part directly in the NKL underlying\nlottery with the same lottery ticket number and size of ticket.<\/p>\n\n\n\n (2)\nAll draws of the NKL underlying lottery take place under official supervision.\nThe draw locations and times are set in advance and will be communicated upon\nrequest.<\/p>\n\n\n\n (3)\nIn the KLN-game, winnings are determined by comparing the tickets that have\nbeen registered for the respective draw with EU Lotto and the respective draw\nresults of the NKL underlying lottery. Depending on the prize tier, 1-, 2-, 3-,\n4-, 5- or 7-digit numbers of the NKL underlying lottery are drawn. For the\nprize tiers from \u20ac 1,000,000 and prize tiers with less than 30 winners as well\nas for non-cash prizes and for the extra income, 7-digit winning numbers are\ndrawn. For all other prize tiers, only the last digits of the winning numbers\nare drawn. In case of non-cash prizes and the extra income, the winning letters\nwill be drawn in addition to the numbers.<\/p>\n\n\n\n (4)\nFor the Jackpot draw of class 1-5, the\nNKL underlying lottery operates a pre-draw, in which a number between 0 and 2\nis drawn. If the number 0 is drawn in this pre-draw, then a 7-digit winning\nnumber will be determined straight afterwards, so the Jackpot draw takes place.\nIf either 1 or 2 is drawn, the Jackpot draw does not take place and the prize\nof the respective jackpot draw will be added to the jackpot draw of the next\ntier. In the 6th<\/sup> class a\n7-digit number will always be determined without any pre-draw.<\/p>\n\n\n\n (1)\nTicket numbers which are drawn as winning numbers of the KLN-game stay in the\ngame. This does not apply to the 4 super draws in 6th<\/sup> class; these\nlottery ticket numbers will be eliminated from the KLN-game before the day of\nthe next super draw or in the 4th<\/sup> super draw before the day of the super draw \u201cFinal\nMillion\u201d.<\/p>\n\n\n\n (2)\nTo continue playing the KLN-game, the service provider will regularly offer the\nplayer to participate with a ticket, which lottery ticket number is still in\nplay (renewal lottery ticket).<\/p>\n\n\n\n (3)\nThe price for a renewal ticket consists of the price for the current class and\nthe preliminary classes.<\/p>\n\n\n\n 4)\nWith the renewal ticket, the player will participate from the day of the next\nmajor draw of the KLN-game or the super draw \u201cFinal Million\u201d, if the payment of\nthe ticket price has been received and stored before the draw – according to \u00a7\n6 (2) and (3).<\/p>\n\n\n\n (1)\nIn the event of a win, the player receives a winning notification from the\nservice provider. In addition, EU Lotto winning numbers and winning letters\nwill be announced in the EU Lotto winning list, which can be viewed or\npurchased at the service provider. Publications other than the NKL underlying\nlottery printed winning list (e.g. digital winning list, television, teletext,\npress and the internet) are without guarantee.<\/p>\n\n\n\n (2)\nThe cash prizes and Gold prizes given in the publication of the NKL underlying\nlottery refer to whole lottery tickets, except for the extra incomes, which go\nundivided to the correct 7-digit number including the correct letter. The\nplayer receives the prize money according to the winnings of the NKL underlying\nlottery. Participants who have purchased ticket shares will receive a share of\nthe prize money according to the ticket shares purchased.<\/p>\n\n\n\n (1)\n The player\nregistered with the service provider for the winning ticket is entitled to\nreceive winnings for this ticket.<\/p>\n\n\n\n (2)\nThe prize money up to \u20ac 1,000,000 shown in the KLN-winning plan are either paid\nout to the player by the service provider immediately or credited to the player\non his client account and, if desired, used with the ticket for the subsequent\nclasses or the renewal lottery ticket (see. \u00a7 9 (2) and (3)).<\/p>\n\n\n\n (3)\nCash Prizes up to \u20ac 1,000,000 are paid by the service provider, cash prizes of\nmore than \u20ac 1,000,000 as well as the extra income are paid by EU Lotto. Non-cash\nprizes and Gold prizes are paid out by EU Lotto in agreement with the winner\nand passed to them. Non-cash prizes can also be paid out in cash at the request\nof EU Lotto. The winning amount is the value shown in the KLN-game winning\nschedule.<\/p>\n\n\n\n (4)\nTo claim winnings, it is sufficient to return the payout instruction form\nenclosed with the winning notification letter.<\/p>\n\n\n\n (5)\nWinnings are tax-exempt or non-taxable in many countries. The player is\nprimarily responsible for the payment of taxes and duties. In the event that EU\nLotto has to pay any taxes, fees or duties directly to the country authorities in\nrespect to a player\u2019s winning, EU Lotto and the service provider shall be\nentitled to deduct the amount from the player\u2019s account or to request the\nplayer to pay the tax amount.<\/p>\n\n\n\n (1)\nEU Lotto is not liable for damages resulting from a service provider\u2019s grossly\nnegligent breach of duty or intentional or negligent breach of pre-contractual\nor contractual obligations of a service provider or other vicarious agents in\nconnection with the initiation or conclusion of the game contract. This\nregulation applies correspondingly for damages that arise after the formation\nof the game contract due to the malfunction of technical equipment.<\/p>\n\n\n\n (2)\nIncidentally, EU Lotto is only liable for damages that are based on intentional\nor grossly negligent breaches of duty by EU Lotto, its legal representatives or\nits vicarious agents.
